These are the terms (the “Agreement”) governing your attendance at and participation in a Mastering Instructional Design Workshop. By registering for the Workshop you agree to these terms, which form a binding legal contract between Mastering Instructional Design (which is legally a part of Simple Useful Tools, LLC) and the registered attendee or participant (“you” or the “Attendee”). If you are registering on behalf of another individual, it is your responsibility to ensure the person attending is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the Attendee aware of these terms and that they have accepted these terms.
Payment
The fee for attending the Workshop (“Registration Fee”) will be as stated on the registration form for the relevant Workshop. All payments for the Registration Fee must be made in full at the time of completing the registration form.
By registering and making payment through Mastering Instructional Design’s online payment system, Attendee authorizes Mastering Instructional Design to charge Attendee’s credit card as payment for Attendee’s participation in the Program. Attendee represents and warrants that all payment information is true and Attendee is authorized to use the payment instrument. Attendee will promptly update Attendee’s payment information with any changes (for example, a change in billing address or credit card expiration date).
Credit and Refund Policy
All payment for the Workshop shall be non-refundable as the recordings will be available. If you are unable to attend the Workshop and wish to transfer your participation to another individual, you may email us at support@masteringid.com.
Cancellation Policy
In the event the Workshop must be cancelled due to an unforeseen circumstance, we shall reimburse you the amounts paid. Our sole liability in relation to any cancellation or postponement shall be limited to the price paid by you for such Workshop and we shall not be liable under any circumstances for any consequential losses. Mastering Instructional Design may also exclude any prospective Attendee from registering for or attending the Workshop, in our sole discretion. Furthermore, Mastering Instructional Design reserves the right to cancel, in its sole discretion, any Attendee’s registration upon refund of the admission fees paid to Mastering Instructional Design; provided, however, that if an Attendee’s attendance or registration is cancelled for violating any prohibition or requirement set forth in this Agreement, Company may retain all fees paid.
Attendee Requirements
Your registration entitles you to admittance to the Workshop. Any and all other costs associated with your attendance shall be borne solely by you, and Mastering Instructional Design shall have no liability for such costs.
By attending the Workshop you acknowledge and agree to grant Mastering Instructional Design the right at the Workshop to record, film, photograph, or capture your likeness in any media to be posted only to this website without any further approval from you or any payment to you. This grant to Mastering Instructional Design includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to view the recordings. You may not photograph or video record the Workshop without our prior consent.
You acknowledge and agree that Mastering Instructional Design, in its sole discretion, reserves the right to change minor aspects of the Workshop, including but not limited to, the Workshop content.
Limitation of Liability & Disclaimer
Although we attempt to accurately disseminate the latest research and best practices related to the topic, Mastering Instructional Design gives no warranties in respect of any aspect of the Workshop or any materials related thereto or offered at the Workshop and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, and timeliness. The Workshop is provided on an “as-is” basis. Mastering Instructional Design makes no representations or warranties in relation to the information provided in the content. Neither Company nor its affiliates accept any responsibility or liability for reliance by you or any person on any aspect of the Workshop or any information provided at the Workshop.
Except as required by law, neither Mastering Instructional Design nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Workshop or other aspect related thereto or in connection with this Agreement. Mastering Instructional Design assumes no responsibility or liability for any loss or damage suffered by any person as a result of use of the information provided through the Workshop.
The maximum aggregate liability of Mastering Instructional Design for any claim in any way connected with, or arising from, the Workshop or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to Mastering Instructional Design under this Agreement.
All of the information provided at the Workshop is for informational use only. Registration or attendance at the Workshop does not form any relationship between the Attendee and Company.
You agree to indemnify and hold Mastering Instructional Design, its parents, subsidiaries, affiliates, officers, directors, employees, agents and representatives harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to, related to, or connected with your attendance or conduct at the Workshop.
We act only as an agent, and assume no responsibility or liability in connection with the services of any building or rented space or service or for any other person engaged in carrying out the workspace arrangements. In the event that it becomes necessary or advisable for the comfort or well-being of the participants, or for any reason whatsoever, to alter the itinerary or arrangements, to change times and days of classes or change classroom venues, such alternatives may be made without liability to us.
Intellectual Property
All intellectual property rights in and to the Workshop, the Workshop content, Mastering Instructional Design’s trademarks and all materials distributed at or in connection with the Workshop are owned by Mastering Instructional Design. You may not use, reproduce, or distribute or allow anyone to use, reproduce or distribute any trademarks, other trade names, copyrighted material, or any other intellectual property appearing at the Workshop, in any Workshop content or in any materials distributed at or in connection with the Workshop for any reason without the prior written permission of Mastering Instructional Design.
For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks, copyrighted material, or other intellectual property rights owned or used under license by Mastering Instructional Design; nor does this Agreement grant to you any right or license to any other intellectual property rights of Company or its affiliates, all of which shall at all times remain the exclusive property of Mastering Instructional Design.
